Marsmall — an open network where individuals, startups, and small businesses share information freely.
Last updated: July 18, 20261 What Marsmall Is
Marsmall is an open business network built for individuals, startups, and small businesses to freely share information about what they offer, what they need, and what opportunities they see. Members create a profile (a "Mars"), publish offers or opportunities, and message one another directly.
Marsmall is a platform, not a participant. We provide the space where users find each other. We do not introduce, endorse, verify, broker, negotiate, guarantee, or take part in anything that happens between users after that.
Specifically, Marsmall is not:
- a data broker, or a seller of user information;
- an employer, recruiter, or staffing agency;
- a sales agent, distributor, reseller, or representative of any user;
- an escrow service, payment processor, or payment guarantor;
- a broker-dealer, investment adviser, or financial intermediary;
- a party to any contract formed between users.
2 A Free Service
Marsmall is provided free of charge. There are no membership fees, listing fees, subscription tiers, or success fees.
Marsmall does not take any commission, brokerage, referral fee, revenue share, or benefit of any kind from any transaction, deal, partnership, investment, or arrangement made between users. We derive no financial interest from your dealings. This is a pure information service, and we intend to keep it that way.
Because the service is free, it is provided "as is" and "as available", with no warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement. We may modify, suspend, limit, or discontinue any part of the service at any time without notice or liability.
3 Your Account
- You must be at least 18 years old, or the age of majority where you live, to use Marsmall.
- You are responsible for the accuracy of the information you publish, and for keeping your login credentials secure.
- You may not impersonate another person, business, or organization, or misrepresent your affiliation with one.
- You are responsible for all activity that occurs under your account.
- You may delete your account at any time. We may suspend or terminate accounts that violate these terms.
4 Your Content
You keep full ownership of everything you post — your profile, offers, opportunities, images, and messages. By posting, you grant Marsmall a limited, non-exclusive, royalty-free license to host, store, and display that content solely for the purpose of operating the service. This license ends when you delete the content or your account, except where we are required to retain records by law.
You are solely responsible for what you post. You confirm that you have the right to post it, that it is accurate and not misleading, and that it does not infringe anyone else's rights.
Marsmall does not verify user content. We do not check whether a business is real, whether an offer is genuine, whether claimed credentials are true, or whether a user can deliver what they promise. Listings are published as submitted.
5 Transactions Between Users
Every transaction is entirely between you and the other user. Marsmall is never a party to it, never a witness to it, and never a guarantor of it.
You alone are responsible for:
- verifying the identity, legitimacy, licensing, and financial standing of anyone you deal with;
- conducting your own due diligence before committing anything of value;
- negotiating and documenting your own contracts and terms;
- arranging payment, delivery, and dispute resolution directly with the other party;
- complying with all laws that apply to you — including tax, export, licensing, sanctions, securities, employment, consumer protection, and anti-corruption laws.
We strongly recommend you seek independent legal, financial, and tax advice before entering into any significant agreement. If a dispute arises between you and another user, you must resolve it directly with that user. Marsmall has no obligation to mediate, investigate, arbitrate, refund, compensate, or intervene in any way.
6 No Liability
To the fullest extent permitted by law, Marsmall and its operators, affiliates, and contributors shall have no liability whatsoever for any loss, damage, cost, claim, or expense of any kind — direct, indirect, incidental, special, consequential, punitive, or otherwise — arising out of or relating to:
- any transaction, agreement, partnership, investment, or dealing between users;
- any act, omission, misrepresentation, fraud, breach, or misconduct by any user;
- any content posted on the platform, or reliance placed on it;
- any loss of profit, revenue, business, opportunity, goodwill, or data;
- any interruption, error, downtime, data loss, or unauthorized access affecting the service.
This applies whether the claim is based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not we were advised of the possibility of such loss.
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims shall not exceed US$100.
You agree to indemnify and hold harmless Marsmall and its operators from any claim, demand, loss, or expense (including reasonable legal fees) brought by a third party and arising from your use of the service, your content, or your dealings with other users.
7 Prohibited Use
You may not use Marsmall to:
- post false, fraudulent, deceptive, or misleading information;
- run pyramid schemes, chain referrals, or any fraudulent investment offering;
- send spam, bulk unsolicited messages, or automated mass outreach;
- scrape, harvest, or bulk-collect user data by any automated means;
- offer anything illegal, or anything restricted under applicable export controls or sanctions;
- infringe intellectual property, publicity, or privacy rights;
- harass, threaten, defame, or discriminate against any person or group;
- upload malware, or attempt to breach, probe, or disrupt the platform's security.
We may remove content or suspend accounts that appear to breach these rules, at our sole discretion and without prior notice. We are not obliged to monitor content, and doing so in one case creates no obligation to do so in another.
8 Privacy — What We Collect
We collect only what the platform needs in order to work. We keep it minimal by design.
Information you give us
- account details: email address and password (stored only as a secure one-way hash);
- profile information you choose to publish: business name, description, industry, country, links, images;
- offers and opportunities you post;
- messages you send to other users through the platform.
Information collected automatically
- basic technical logs: IP address, browser type, timestamps, and pages requested, used for security and abuse prevention;
- an essential session cookie that keeps you logged in.
We do not use advertising cookies or third-party tracking pixels, and we do not build advertising profiles about you.
What is public
Anything you publish to your profile, offers, or opportunities is publicly visible and may be indexed by search engines. Do not post information you do not want the world to see. Your email address and password are never displayed publicly.
9 How We Use and Protect Data
We use your information only to:
- operate your account and display your listings;
- deliver messages between you and other users;
- send essential service notices (we do not send marketing email you did not ask for);
- detect and prevent fraud, spam, and abuse;
- comply with legal obligations.
We never sell, rent, trade, or monetize your personal information. We are not a data broker and we do not share your data with advertisers. We disclose data only to infrastructure providers strictly necessary to run the service (such as hosting and email delivery), and where required by valid legal process.
We use reasonable technical and organizational safeguards, including encrypted transport (HTTPS) and hashed passwords. However, no system is completely secure, and we cannot guarantee absolute protection of data transmitted to or stored on the platform.
We retain your data for as long as your account is active. After deletion, we remove personal data within a reasonable period, except for limited records we must keep for legal, security, or accounting purposes.
Marsmall may be operated from, and data may be processed and stored in, jurisdictions other than your own. By using the service you consent to such international transfer.
10 Your Rights
Depending on where you live, you may have the right to access, correct, export, restrict, or delete the personal data we hold about you, and to object to certain processing. You can edit or remove most of your information directly from your account at any time. For anything else, contact us and we will respond within a reasonable period.
Marsmall is not intended for anyone under 18. We do not knowingly collect data from children. If you believe a minor has created an account, please contact us and we will remove it.
11 Changes and General Terms
We may update this document from time to time. Material changes will be reflected in the "last updated" date above, and continued use of the platform after that date means you accept the revised terms.
If any provision of this document is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any right does not waive it. These terms constitute the entire agreement between you and Marsmall regarding the service.
This document is written in English. If it is translated into another language and a conflict arises, the English version governs.
12 Contact
Questions about these terms, your data, or anything else on the platform can be sent to the operator of Marsmall through the contact details published on the site. We read everything, and we answer as promptly as we can.
